Terms of service
Article 1 – Parties
These Terms and Conditions govern the relationship between SOLINE ESSENTIALS on the one hand and the Customer on the other.
SOLINE ESSENTIALS (hereinafter “Soline”), located at Zandstraat 22, 3140 Keerbergen, Belgium, registered with the Belgian Crossroads Bank for Enterprises (KBO) under company number BE0760.747.739, offers certain Products and Services through its e-commerce website https://solineessentials.be/.
The Customer is an internet user who wishes to purchase these Products or use these Services.
Soline and the Customer are individually referred to as a “Party” and collectively as the “Parties”.
Article 2 – Legal capacity and acceptance
Anyone wishing to purchase Soline Products must be legally competent, or otherwise make the purchase through their legal representative.
The Customer expressly accepts the Terms and Conditions during the order process by checking the box or selecting the words “I accept the Terms and Conditions.”
The Customer may print these Terms and Conditions.
Article 3 – Products
The Products offered for sale are those displayed on the website at the time the Customer visits and which are indicated as sold by Soline.
Products are offered for sale subject to availability and only in the usual quantities for private use.
If one or more Products are no longer available, Soline will inform the Customer in writing or by email. In such cases, the Customer will be immediately reimbursed via the same payment method used for the original purchase. Refund times may vary depending on the Customer’s chosen payment method. If the Customer considers the refund unreasonably delayed, they may contact their bank.
All Products offered for sale on the website are described in good faith, carefully and as accurately as possible. The photos shown on the website are as reliable as possible, but no guarantee can be given that the Products will be perfectly identical to the photos. Soline cannot be held liable for minor errors or discrepancies in descriptions and images of the Products, including small variations in color and size.
Article 4 – Prices and payment
The applicable prices are those stated on the website at the time the Customer places the order.
Prices shown during the purchase process are in euros, including VAT and administrative costs.
Product and service prices exclude shipping costs, which are charged separately on top of the purchase price as specified when placing the order. Discounts to which the Customer is entitled are deducted separately from the price.
Soline reserves the right to change sales prices and shipping costs at any time, but the price charged for purchased Products and shipping costs will be the price stated in the confirmation email, i.e. the price applicable at the time of purchase.
The Customer receives confirmation of the order and the accompanying invoice on a durable electronic medium.
Products remain the property of Soline until the Customer has fully paid for the Product, i.e. until the purchase price and shipping costs have been paid in full.
In the event of a clear pricing error for a Product ordered by the Customer, Soline will inform the Customer as soon as possible and offer the option to place a new order at the correct price. In any case, Soline will cancel the initial order and refund the Customer.
Soline accepts the following payment methods: [to be specified].
If the Customer’s bank refuses payment, no contract is concluded between the Customer and Soline. Once the Customer’s financial institution accepts payment, the contract between the Customer and Soline is concluded.
Soline reserves the right at all times to refuse to execute an order from a Customer with whom it has or has had a dispute, or who has partially or wholly failed to pay for a previous order.
Article 5 – Delivery
If a delivery is lost during the delivery process, and the provisions of this article have been met, Soline will, at its own cost, either resend the Product (if available) or refund the value of the Product and shipping costs.
The risk of loss and/or damage passes to the Customer upon delivery at the delivery address specified in the order or any other delivery preference provided by the Customer.
Article 6 – Right of withdrawal
The Customer has fourteen (14) days from receipt of the ordered Products to exercise their statutory right of withdrawal and return the goods, without giving any reason.
The Customer must notify Soline of their decision to withdraw by sending a clear and unambiguous declaration by email to info@solineessentials.be. The Customer must return the Products immediately, and at the latest within fourteen (14) days of notifying Soline of their decision to exercise the right of withdrawal. Products must be returned in new and unused condition, with all original labels attached, and at the Customer’s expense. The Customer is responsible for the Products (including damage or loss) until Soline has received them.
If the above conditions are met and Soline has received the returned Products, Soline will refund the Customer the full amount of the order, including initial shipping costs (excluding any additional costs resulting from the Customer’s choice of a shipping method other than the cheapest standard method offered by Soline).
The full purchase price (including standard shipping costs) will be refunded within 14 calendar days after Soline has received the returned goods in time, provided all conditions are met. The refunded amount will never exceed the actual amount paid by the Customer.
Refunds will be made using the same payment method used by the Customer for the original transaction, unless expressly agreed otherwise, and the Customer will not incur any fees for such reimbursement. Gift cards and discounts used for the order will be taken into account. Refunds will follow the procedure agreed with the bank that issued the card.
The Customer is liable for any reduction in the value of the Products if this results from handling beyond what is necessary to establish the nature, characteristics, and functioning of the Products.
The right of withdrawal does not apply to personalized or made-to-order Products.
As many Products are handmade and unique, exchanges or substitutions are not possible.
Article 7 – Legal warranty
In case of defective or non-conforming goods, the Customer may contact Soline at info@solineessentials.be.
The Customer is entitled to a two-year statutory warranty for goods, as described below.
From the moment Soline receives the defective Product, Soline will, at the Customer’s choice, repair the defect or replace the Product with a non-defective Product (the supplementary performance). The Customer must give Soline a reasonable opportunity and period to provide the supplementary performance before submitting other warranty claims. Soline may refuse the Customer’s chosen supplementary performance if it involves disproportionate costs or is impossible due to the unique nature of the defective Product.
If supplementary performance fails, the Customer may, at their choice, obtain a price reduction under statutory provisions or terminate the contract.
The right to terminate is excluded if the delivered Products only slightly deviate from the agreed quality, or if the contractual or normal use of the Products is only slightly impaired.
Customers must contact Soline immediately if they wish to invoke the statutory warranty. In any case, they must notify Soline in writing of the non-conformity within two months of discovering the defect.
The warranty does not apply to Products intentionally or negligently damaged by the Customer, nor to damage resulting from wear and tear, transport, or improper use.
Article 8 – Liability
To the extent permitted by law, Soline can in no case be held liable for loss (including loss of use, loss of profit, loss of opportunity) directly or indirectly resulting from use of the website or inability to use the website. Soline cannot be held liable for damage to the Customer’s systems incurred before visiting the website, including hacking or computer viruses.
Soline cannot be held liable for non-delivery of orders due to Products being out of stock or reasons beyond its control, including force majeure circumstances such as disruption or interruption of transport, postal, or communication services, flooding, fire, accidents, or damage inherent in the use of the network.
Article 9 – Workshops
Soline offers workshops, to which the following specific conditions apply:
9.1 – Cancellation
Cancellations are permitted up to 30 days before the start of the workshop, with a full refund. For cancellations made later than 30 days before the workshop:
- Cancellation up to 7 days before the workshop: the Customer is entitled to a voucher for a later workshop. No refund will be given.
- Cancellation within 7 days before the workshop: the Customer is not entitled to a voucher or refund. However, the workshop may be transferred to a third party.
9.2 – Liability
Soline is not liable for defects in the Product resulting from the nature of the clay or the firing process.
If your piece shows a defect before it goes into the kiln, Soline will contact you to decide whether the piece will still be fired. If the piece is broken, you have the right to purchase it at a discount proportional to the defect.
If the Product is damaged due to Soline’s fault or negligence during transport or finishing, the Customer will be entitled to a completely free recreated piece by Soline.
Article 10 – Gift Cards
Soline sells Gift Cards, subject to the following general conditions:
- They can only be used on the website (https://solineessentials.be/) by entering the code stated on the Gift Card.
- They are valid for one (1) year.
- Gift Cards may be redeemed in whole or in part. If the Customer does not use the full amount at once, they will receive a new code for the remaining balance.
- The Customer can set the value of the Gift Card between … and … EUR.
- If the total order amount exceeds the value of the Gift Card, the balance must be paid using one of the available payment methods.
- Without prejudice to the Customer’s right of withdrawal, Gift Cards and Products purchased with Gift Cards cannot be exchanged for cash or other payments, even partially.
- Soline is not liable in case of theft, resale, destruction, loss, or unauthorized use of Gift Cards.
Article 11 – Intellectual Property Rights
For the purpose of this clause, “Intellectual Property Rights” means all rights such as copyrights, trademarks, designs, know-how, and registered domain names, including but not limited to the domain name “……” or any translation and/or representation thereof or related terms, as well as texts, databases containing data published on the website, the layout, look and feel and graphic design of the website, the sales catalogue, photos, images, and videos on the website protected under copyright, database rights, trademark rights, patent rights, or any other form of intellectual property rights.
The Customer acknowledges these intellectual property rights and undertakes to comply with them at all times.
Soline is and will remain the exclusive owner of these Intellectual Property Rights at all times.
The Customer may not copy, publish, imitate, exploit, or otherwise use Soline’s Intellectual Property Rights in any way or form without Soline’s prior written consent. Such consent must be obtained in writing, unless Soline has granted a right to share certain aspects of the Intellectual Property Rights through social networks. In such case, the rights granted are limited to the specific elements of the Intellectual Property Rights identified by Soline and to the uses and social networks for which Soline has enabled such sharing. In any case, the granting of such rights is strictly non-exclusive.
Article 12 – Contact and complaints
For questions or complaints regarding their purchase, Customers can contact Soline by sending an email to info@solineessentials.be.
Article 13 – Miscellaneous
13.1 – Applicable law and jurisdiction
All disputes between the Parties regarding the purchase of Products under these Terms and Conditions shall be submitted exclusively to the courts of Antwerp, Belgium. These Terms and Conditions and all claims and disputes arising therefrom are governed exclusively by Belgian law.
13.2 – Amendments
Soline may amend these Terms and Conditions at any time, including to comply with legal obligations. Amendments communicated via the website apply to all offers and purchases made after publication of the amendment.
Soline reserves the right to adapt the design and content of the website at any time.
